This agreement outlines the terms and conditions governing the use of the website development and hosting services provided by myEzCollect.com LLC ("we", "us", or "our"). By engaging with our services, you ("you" or "client") agree to the following terms:

1. Description of Services:

a. Managed WordPress Web Hosting: Our Managed WordPress Hosting plans offer a streamlined and optimized experience to build and manage WordPress sites. We handle basic hosting administrative tasks, including installing WordPress, automated daily backups, and server-level caching. However, clients do not have administrator (root) access or a dedicated IP address.

b. Managed Support: Managed Support plans provide core patching, security, monitoring, and backups on a monthly subscription basis. Additional configurations and installations can be performed for an additional fee.

c. Hosting Premium Support/Expert Services: Expert Services are additional custom support services available for a set fee, offering assistance with complex tasks such as optimizing databases or configuring firewalls.

d. Hosting Backup: Our backup and restore services save website files to the cloud twice per day. These services are available with website hosting plans and may be available for an additional fee with other hosting service plans.

2. Account Termination; Limitations:

a. Migration of Servers: We reserve the right to migrate our servers as necessary, which may result in the assignment of different IP numbers. We do not warrant consistent maintenance of given IP numbers.

b. Termination of Hosting Services: Upon expiration or termination of hosting services, clients must discontinue use of the services and relinquish use of assigned IP addresses and server names. Clients are responsible for moving website content off our servers prior to termination.

3. Your Obligations; Representations and Warranties:

a. Justification: We reserve the right to seek justification for the use of hosting services, including the purchase of IP addresses. Clients are obligated to provide requested information.

b. Abusive Activities and Other Threats: Clients may not engage in abusive activities that threaten network stability or damage systems. We reserve the right to remove sites or suspend services for violations.

c. Storage and Security: Clients are responsible for preventing loss or damage to website content, maintaining independent backups, and ensuring security of transmitted data.

4. Third-Party Software:

a. Definition and Scope: Clients may use third-party software as part of the hosting services, subject to additional terms and conditions. We do not make representations or warranties about third-party software and disclaim liability for its use.

b. Terms and Conditions: Client's use of third-party software is subject to applicable licenses and agreements. We may provide personal information to third-party providers as required.

5. Service Uptime Guarantee:

We offer a Service uptime guarantee of 99.9% of available time per month. If we fail to maintain this guarantee, clients may request an account credit of 5% of their monthly hosting fee.

By engaging with our website development and hosting services, you acknowledge and accept the terms outlined in this agreement and the accompanying disclaimer. If you do not agree with these terms, please refrain from using our services.

1. Website Content: All content provided on websites hosted by us is the sole responsibility of the client. We do not assume responsibility for the accuracy, legality, or appropriateness of client-provided content. Clients are solely responsible for ensuring that their content complies with all applicable laws and regulations.

2. Termination of Hosting Agreement: We reserve the right to terminate the hosting agreement at any time for any reason, including but not limited to violation of our terms of service, non-payment of fees, and without notice in the event of any activity deemed harmful or inappropriate. Please note that all fees paid to us are non-refundable, regardless of the reason for termination.

3. Mandatory Future Updates: Due to evolving industry standards, including security and browser updates, clients should expect to be responsible for mandatory future updates to maintain compliance, functionality, and compatibility of their websites. While we will make reasonable efforts to assist with these updates, we assume no service commitment, financial obligation, or guarantee of continued capability or performance; clients are ultimately responsible for ensuring the ongoing maintenance and compliance of their websites.

4. Browser Compatibility: Websites developed by us are designed to be compatible with modern web browsers. However, we cannot guarantee full compatibility with all browsers and versions. Clients are advised to test their websites across multiple browsers and devices to ensure optimal performance.

5. Security Standards: We implement industry-standard security measures to protect websites hosted on our servers. However, clients are responsible for maintaining the security of their website content, including securing user data and adhering to data protection regulations. We are not liable for any security breaches or data compromises resulting from client negligence or misconduct.

6. Outdated Technologies: Websites continuing to use outdated technologies may become vulnerable to security threats and compatibility issues. Clients are encouraged to upgrade their websites to the latest technologies and standards to mitigate these risks. We are not responsible for any damages or liabilities arising from the use of outdated technologies, and reserve the right to terminate any site that poses a larger risk to the server.

7. Third-Party Content: Our website development and hosting services may involve integrating third-party content, such as plugins, themes, or external services. While we take reasonable precautions to ensure the integrity and security of third-party content, we cannot guarantee its reliability or suitability for all purposes. Clients are advised to review and vet third-party content before integration.

8. Limitation of Liability: In no event shall we, our employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our website development and hosting services. This includes, but is not limited to, loss of revenue, data, or business interruption.
